By accessing and using zTiles ("Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.
zTiles provides a platform for creating spatial maps, processing videos with AI, and discovering connections across the internet. The Service includes various features such as interactive mapping, content extraction, video processing, and AI-powered analysis.
3.1 Registration: You must provide accurate, current, and complete information during registration and maintain and update such information to keep it accurate, current, and complete.
3.2 Account Security: You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
3.3 Account Termination: We reserve the right to suspend or terminate your account if you violate these Terms or engage in any fraudulent, abusive, or illegal activity.
3.4 Email verification: Certain features, including redeeming Z-Credits for Monero (XMR) payouts, require a verified email address. You agree to keep your email current and to complete verification when requested.
3.5 Two-factor authentication (2FA): Withdrawals and redemptions involving Z-Credits or Monero may require an authenticator app (TOTP). You are responsible for safeguarding your 2FA device and recovery access. We are not liable for losses caused by failure to enable or maintain 2FA when required.
4.1 Subscription Plans: We offer various subscription plans with different features and limits. You can upgrade, downgrade, or cancel your subscription at any time through your account settings.
4.2 Billing: Subscriptions are billed monthly or annually in advance. All fees are non-refundable except as required by law or as explicitly stated in these Terms.
4.3 Price Changes: We reserve the right to modify subscription fees. We will provide at least 30 days notice of any price changes. Continued use of the Service after the price change constitutes acceptance of the new pricing.
4.4 Refunds: Refunds are provided at our discretion or as required by applicable law. If you cancel your subscription, you will continue to have access until the end of your billing period.
You agree not to use the Service to:
6.1 Our Content: The Service, including its original content, features, and functionality, is owned by zTiles and is protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.
6.2 Your Content: You retain ownership of any content you create or upload to the Service. By using the Service, you grant us a worldwide, non-exclusive, royalty-free license to use, store, and process your content solely for the purpose of providing the Service.
Your use of the Service is also governed by our Privacy Policy. Please review our Privacy Policy to understand how we collect, use, and protect your information.
8.1 Z-Credits: Z-Credits are a limited, non-transferable in-platform balance used for zTiles features. They are not legal tender, securities, or bank deposits. We may change conversion rates, fees, or availability with notice where required.
8.2 Monero (XMR) deposits and redemptions: Where offered, you may purchase Z-Credits with Monero or request redemption of Z-Credits for Monero subject to verification, review, and applicable fees. You must provide an accurate external Monero address. Transactions on public blockchains are irreversible.
8.3 Your responsibility: You are solely responsible for your wallet addresses, private keys, and account credentials. Losses from typos, phishing, malware, device theft, SIM swap, compromised email, disabled 2FA, or unauthorized account access are your responsibility.
8.4 No custody guarantee: We do not guarantee recovery of lost, stolen, or misdirected cryptocurrency. We may delay, decline, or reverse platform balances (not on-chain funds already sent) when fraud, sanctions, or policy violations are suspected.
8.5 Compliance: You represent that your use of cryptocurrency features complies with applicable law in your jurisdiction. We may restrict features by region or account status.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, NAPKNBOOK AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUES, Z-CREDITS, CRYPTOCURRENCY (INCLUDING MONERO), DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, INCLUDING LOSSES ARISING FROM ACCOUNT COMPROMISE, UNAUTHORIZED WITHDRAWALS, INCORRECT WALLET ADDRESSES, BLOCKCHAIN DELAYS, WALLET SOFTWARE FAILURES, OR THIRD-PARTY SERVICES-WHETHER OR NOT WE WERE ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR AGGREGATE LIABILITY FOR CLAIMS RELATING TO THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) AMOUNTS YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS (USD $100), EXCEPT WHERE PROHIBITED BY LAW.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT UNINTERRUPTED, ERROR-FREE, OR SECURE OPERATION OF CRYPTOCURRENCY OR PAYOUT FEATURES.
You agree to indemnify and hold harmless zTiles, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of or relating to your use of the Service or violation of these Terms.
12.1 By You: You may terminate your account at any time by canceling your subscription and deleting your account through the account settings.
12.2 By Us: We may terminate or suspend your account immediately, without prior notice, if you breach these Terms or engage in any fraudulent, abusive, or illegal activity.
We reserve the right to modify these Terms at any time. We will notify users of any material changes by posting the new Terms on this page and updating the "Last updated" date. Your continued use of the Service after such modifications constitutes acceptance of the updated Terms.
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which zTiles operates, without regard to its conflict of law provisions.
